These Terms are important so please read them carefully. They apply to your activities on the Mama’s Soul Food application. Part 1 applies whenever you use the App; Part 2 applies when you log in.
This Part always applies when you use the App. By clicking to accept these Terms you are legally bound by them. We may update these Terms from time to time — we’ll notify you of significant changes by email, and updates take effect the next time you access your account.
We are Mama’s Soul Food (“Company”, “we”, “our” or “us”). We own Mama’s Soul Food Restaurants and offer our customers an App with functionality related to our venue and any other services we may make available through it from time to time (“Services”).
If you have any questions about these Terms, our Services or any technical issues with the App, email us at hello@mamassoulfood.co.uk. Complaints may be sent to the same address, or by post to our registered address.
The App is for your own personal and non-commercial use only. When using the App and your Account, you agree not to undermine the security or integrity of the App or any system used to deliver it; impair its functionality or the experience of other users; attempt to gain unauthorised access to materials or systems; upload files or content that may damage others’ devices, is offensive, or infringes the rights of third parties; create links to the App without our written consent; modify, copy, adapt, reverse engineer or decompile any of the programs that deliver the Services; impersonate another person; behave in a vulgar, offensive or harassing manner; or use the App for any unlawful purpose.
Any security breach will be reported to the relevant law enforcement authorities, and we will co-operate with them including by disclosing your identity if required.

Read our Privacy PolicySome Services on the App require you to turn on the “location” functionality on your device.
Our App and the Services are provided on an information-only basis. You should not rely on, or take (or not take) any decision based solely on information or suggestions found through our App. Any actions or decisions you take are entirely at your own risk.
Other than as set out in these Terms, the App is provided on an “as is” and “as available” basis. We make no representations or warranties, express or implied, as to the operation of the App, the Services or any information, content or products made available through it.
We do our best to ensure information in the App is accurate and up to date, but cannot guarantee this will always be the case. We aim to keep the App available at all times, but it may occasionally be unavailable due to maintenance or factors outside our control. We follow industry standards to protect against viruses, malware and malicious attacks, but cannot guarantee the App will be totally free from them, nor that it will be compatible with every device, operating system or software version.
The App may contain links to third-party websites or programs that are not controlled by us. We are not responsible for their content, terms, offers or privacy policies — please read their own policies before using them.
We may change, modify, amend or remove some or all of the functionality or content on the App at any time. You agree that we may freely use any comments, information or ideas contained in any feedback you send us, without compensation or acknowledgement, for any purpose including developing, manufacturing and marketing products and services.
We and our licensors are the owners of the App and of all intellectual property rights in it — including software, applications and domains, and any content, video, audio, graphics, logos, icons and service names (except for your profile picture and personal information inside your account). You do not acquire any rights to that intellectual property other than as expressly set out in these Terms.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any matter which it would be illegal for us to exclude. Otherwise, we are only liable to you for losses that are a direct and reasonably foreseeable result of our breach of these Terms, and not for any other losses or for business losses (including but not limited to loss of profits, contracts, goodwill or opportunity).
You can request your Account be deleted by emailing us at hello@mamassoulfood.co.uk. Once your Account is deleted you will no longer be able to access it or the information held in it, and these Terms will end.
We may suspend your access to your Account or terminate your Account at any time and for any reason. We will let you know as soon as possible if we do.
These Terms and all communications between us will be in English. You may not transfer any of your rights under these Terms to another person. We may transfer any of our rights, or ask another person to fulfil part of our obligations, so long as performance of these Terms is not affected.
Only you and we have any rights under these Terms — no other person has any rights under them. These Terms are governed by English law, and any court proceedings related to them must be brought in a court within England and Wales.
This Part applies to using features within your Account.
Without an account you can still use a limited range of functionality in our App. To access the full range of features you must register an account (your “Account”). You must be at least 18 years old and a resident of the United Kingdom to register; the App is intended for use only in the UK.
You must keep your username and password secure and confidential. You are responsible for any activity on your Account, and it is your sole responsibility to monitor and control access to it. You agree to keep your information accurate, complete and current.
You may make copies of your information contained in your Account in any format, and in doing so may copy reasonable portions of the App and its material and content.
We may award you with offers or discounts that can be used or redeemed in our restaurants (“Rewards”). Rewards will be made available and stored in the App, and can only be redeemed as stated. They cannot be exchanged for like-for-like items, other similar items, or for cash, and have no cash value.
Rewards are personal to you and may not be sold, transferred or assigned to another person. Unless specified otherwise, Rewards are single-use — once a Reward is redeemed it is automatically removed from your Account.
We distribute and award Rewards in our sole discretion, and reserve the right to terminate, discontinue, cancel or amend any Rewards — including any already in your Account — at any time.
